The Software may only be transferred if the transferee accepts the terms and conditions of this Agreement. Licensee is obliged to inform the transferee of these terms and conditions. Subject to sub-Clause 5.1, the Software is provided «as is» without any warranty of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
