Description

Vagisan Cream 50g is a hormone-free treatment used to supplement your natural lubrication to help reduce discomfort associated with vaginal dryness. Subject to the outcome of the application for permission to appeal to the Court of Appeal, the Defendants will be required to cease marketing and sales in the UK of all feminine hygiene products under the VAGISAN sign. The Court refused the Defendants' application for a 21-week stay of the injunction to give time to rebrand their goods. This would amount to authorising the Defendants' continued infringement and, on the facts, there was no justification for doing this.

Following its views on similarity and distinctiveness, and given the evidence available on actual confusion (including evidence on social media and broadcast media such as Gogglebox), the Court concluded that there was a risk of confusion between VAGISIL and VAGISAN. Comment

Mr Justice Adam Johnson concluded that the average consumer would not have been accustomed to seeing Vagi as a signposting device in the female intimate health sector in 2013, in the same way as Opti, Pedi or Nico are in their respective sectors. The defendants' own trade witness could only identify one other product with the same prefix (Vagifem) being sold in the UK at that time, but this was a prescription only product.

Dr Wolff Vagisan Protective Ointment keeps away external influences that may harm the skin including, vaginal discharge, sweat and urine. Helps to soothe irritated skin caused chafing during sporting activities and friction caused by tight clothing.Uncommon: mild local irritation (itching, stinging) may temporarily occur, as well as a slight discharge in some cases. Very rare: hypersensitivity reactions (e.g. redness, stinging) may occur.

Vagisan Moist Cream is for use both internally and externally, with or without the applicator. To apply on the external genital area you should use a clean finger to spread the cream - about 0.5cm of product should suffice. Use this application method for the vaginal opening and external genital area up to several times a day as needed. If the tube or applicator is damaged, or if there are any changes in the appearance of the cream, do not use the product and inform the manufacturers. The Claimant group (Combe International) is a major retailer of non-prescription female intimate healthcare products in the UK and worldwide, which are marketed and sold under the brand VAGISIL. The Claimants first registered VAGISIL as a trade mark in the UK in 1975 and Vagisil products have been available on the UK market since 1984. you've previously signed in to your Google Account on another device. In 2016, Dr Wolff sought to increase its UK presence and Vagisan products began to be sold in Boots stores. It also invested in a television advertising campaign, which (unfortunately for the Defendants) saw an increase in sales of both Vagisan and Vagisil products (described in Court as the 'halo effect').

Other dosage forms

If any of the above symptoms apply to you, you should avoid using Vagisan Moist Cream until you have discussed them with your GP first. What Is Vagisan Moist Cream? In light of the nature of the products, together with considerable evidence of actual consumer confusion between the competing signs, the High Court concluded that there was a risk of confusion between VAGISIL and VAGISAN, and also with DR WOLFF's VAGISAN. Court of Appeal Decision The Court of Appeal largely dismissed Dr Wolff's appeal, confirming both VAGISAN and DR WOLFF's VAGISAN infringed the VAGISIL marks. Whilst, as explained below, the Court of Appeal disagreed with the High Court's approach to interruption of the statutory acquiescence period, the Court of Appeal still upheld the infringement ruling because the Claimants were unaware of Dr Wolff's use of VAGISAN for a long period during 2015 and 2016 despite keeping a watch for such use. For further instruction on how to apply the cream using the applicator refer to your product leaflet which comes in the box. This will contain in depth instructions and a diagram, ensuring it is made clear to you the proper way to insert the cream. It is recommended that you read the product leaflet before use.
